SARASOTA CRIMINAL BLOG: Most Sarasota Murders Now Being Committed By Teenagers

According to an article on tbo.com, Sarasota is seeing a disturbing rise in teenagers and young adults committing murders. The article quotes Sarasota Police Chief Bill Spitler as saying over the past few years most of the city’s murder victims have been killed by teens or those just above the adult threshold. He added that the department has not arrested anyone in these murders above the age of 19.

Even more disturbing than the age of the alleged murders in Sarasota is the victims they are killing. Most are innocent people according to Spitler. Looking at the murder victims and you’ll find an Iraq war veteran who was killed in the middle of the day at a gas station. Or William Holley who is believed to have been killed because he drove down the wrong street at the wrong time. The trend isn’t isolated to Sarasota as there has been a 55% increase in the number of young adults charged with murder or manslaughter in Florida since 2003.

TAMPA CRIMINAL BLOG: Man Accused Of Texting In Fatal Crash Faces Manslaughter Charge

A judge in California is allowing prosecutors to move forward with a charge of manslaughter against a man who is accused of killing a pedestrian due to being distracted while texting. An Associated Press story on the Bradenton Herald website reports that Martin Kuehl is facing manslaughter charges after he struck and killed an Orange County woman who was crossing at a crosswalk.

Kuehl is facing up to nine years in prison on the charges that his defense attorney tried to have reduced to a misdemeanor. The judge, while noting that the defendant was not texting at the exact time of the accident, he did have his cell phone in his hand and prior to the crash had been texting back-and-forth. He will now stand trial for gross vehicular manslaughter as the judge ruled the accident was caused by more than ordinary carelessness.

BRADENTON CRIMINAL BLOG: Missed Court Appearance Leads To Discovery Of Marijuana, Cocaine and Heroine

A Manatee County 32-year-old is facing eight charges following an alleged missed court appointment according to a story on-line at the Sarasota Herald Tribune website. Dennis Smalls was arrested at his home Saturday when he resisted arrest and caused deputies to stun Smalls twice with a Taser.

Once in custody, deputies searched Smalls’ car and found 85 packets of heroine, marijuana and crack cocaine. Smalls now faces eight charges including driving with a suspended license, resisting arrest and contempt of court.

FLORIDA DUI BLOG: Woman Looks For Reduced Sentence Following DUI Plea In Fatal Crash

The list of tragic DUI accidents in Hernando County seems to be a long one lately. One of those cases has resurfaced despite the fact the defendant in the case already accepted a plea that included a sentence of 13 years in jail. Barbara Diffendal pled guilty to DUI causing an accident that took the life on Jeanine Bethoney but according to an article in Hernando Today’s online newspaper, the woman is telling her side of the story in hopes of a reduced sentence.

A motion has been filed by Diffendal asking that her sentence be reduced. She tells a story of how she had tried to have a friend drive her to work after she had a couple of beers but when her ride failed to show she took to the roads with her daughter in tow. While driving Difendal says all the light’s on her dashboard began to flash and the car swerved. She tried to regain control of the car but overcompensated and ended up jumping the median and causing the head-on collision. She claims she left the scene to use the phone having no idea how serious the accident was. Blood tests later showed Difendal had a blood-alcohol content of 0.05, which is below the legal limit but she also had cocaine in her system. She is asking for house arrest following the mandatory four years in prison.

SARASOTA CRIMINAL BLOG: Confession Of Man Accused Of Killing His Mother And Grandfather Thrown Out

A Manatee County judge’s ruling that an accused murderer’s confession should be thrown out was upheld by the Second District Court of Appeal according to an article on Bradenton.com. Bradenton police detectives violated the rights of Clifford Davis by questioning him before and after reading him his Miranda Rights according to the ruling.

Davis admitted to killing his mother, having sex with her dead body and then going to the mall to shop according to court documents. His grandfather picked him up from the mall and upon returning to the apartment where he earlier killed his mother he killed his grandfather by standing on his neck until he died.

Prosecutors have charged Davis with two counts of first degree murder and are seeking the death penalty. Despite asking for an attorney, police continued to question Davis for hours. He eventually confessed to the crimes.

St. PETERSBURG CRIMINAL BLOG: Police Are Investigating Cocaine Found At Pinellas County Fire Station

A criminal investigation is underway in St. Petersburg following the discovery last week of cocaine in a fire station washing machine. The investigation is occurring on two fronts according to the St. Petersburg Times. The first is a criminal investigation by narcotics detectives. The second is being conducted by police internal affairs officers.

The cocaine was found a week ago in a small plastic bag. According to reports many firefighters were doing laundry at the time the illegal drug was discovered and that fire fighters from all over the city rotate in and out of Station 8. Police officials have not released any other details at this time.

FLORIDA DUI BLOG: Woman Arrested For DUI Nearly Runs Over Deputy During Stop

Tracey Brown was driving without her headlights on Monday night in Hernando County. Two deputies had just finished a traffic stop when they noticed the 48-year-old’s car heading towards them according to an article in Hernando Today online. The deputies motioned for Brown to pull over and while complying with the request she nearly hit one of the officers.

According to police reports Brown pulled over and nearly struck one of the deputies with her car before swerving to avoid the police officer. When Brown stopped her vehicle deputies approached and noticed signs of impairment and then gave Brown field sobriety tests, which she reportedly failed. The deputies then arrested the woman on DUI charges.

TAMPA CRIMINAL BLOG: Hillsborough County Courthouse Spokesman Charged With Drug Possession Following Hit-And-Run

Calvin Green, the spokesman for the Hillsborough County Courthouse, has been charged with possession of a controlled substance after he admitted to owning a bag of marijuana and a pipe according to police reports published on the St. Petersburg Times website. Police spotted the pot and paraphernalia at Green’s home while investigating a hit-and-run.

The discovery of the drugs came when an officer was doing a follow up investigation on a traffic crash and saw one of the cars, believed to belong to the suspect, in the driveway of the 56-year-old Green. The officer tried to get someone to answer the door at the house but when nobody did, he began walking around the Tampa home where he spotted the suspect asleep inside. It was at this time the officer apparently spotted a bag of marijuana and pipe. Upon a search of his home, officers found 19 grams of marijuana inside.

TAMPA CRIMINAL BLOG: Polk County Man On Probation For Stalking Captured After Removing Monitoring Bracelet

Manuel Lopez is on probation for aggravated stalking a 14-year-old. Part of the terms of his probation was house arrest which was monitored by an ankle bracelet. Lopez removed the ankle bracelet last week and police began a search for the Mulberry resident according to a story published on tbo.com.

Lopez, 42-years-old, was tracked down at a Domino’s Pizza in Plant City according to the sheriff’s office where he was placed under arrest. The Plant City Police got a tip that Lopez was at the Domino’s. Family members feared he was on the run with his 73-year-old father but that did not turn out to be the case.

TAMPA CRIMINAL BLOG: East Tampa Arrestee Claiming He Was Beaten By Tampa Police

A 20-year-old East Tampa man who was booked in Orient Road Jail has been charged with resisting arrest as reported on TampaBay.com. Clarence Jones tells a different story claiming he was beaten by an officer while they were pursuing a marijuana arrest. TPD is investigating the man’s charges.

Officer James Neil asked Jones for identification after seeing him and thinking he looked like that he had previously charged with trespassing. At that point the officer said he detected the smell of marijuana, a charge he was arrested on in 2008. When the officer went to search Jones he stiffened up. At that time officers say they took the suspect to the ground but he continued to resist. Officer Elvin Cruz admitted striking the suspect in the face to break his focus and the tactic was successful.

ST. PETERSBURG CRIMINAL BLOG: Pinellas Man With 21 Prior Arrests Accused Of Domestic Battery With His Car

St. Petersburg Police are looking for 26-year-old Teico Atkins following an incident where he allegedly rammed his car into another vehicle that contained his ex-girlfriend and their three children. He is being charged with domestic battery and child abuse according to a story published on the St. Petersburg Times website.

According to police Atkins rammed his vehicle into the car of ex-girlfriend Sheneka Arnold. Inside the car were four children, three of whom were Atkins’. He then chased her car for several blocks before Arnold saw a police car and began to honk to get the officer’s attention. At that point Atkins fled the scene. Atkins has 21 prior arrests for various crimes including trafficking and fleeing and eluding.

ST. PETERSBURG CRIMINAL BLOG: Army Reservist In Palm Harbor Charged With A Felony In Sexual Battery Case

Army Reservist Patrick Doyle is being held at the Pinellas County Jail after being charged with domestic battery and felony attempted sexual battery. The 27-year-old is accused of hitting his girlfriend, throwing lit cigarettes at her and trying to force her to have sex according to a report published on the St. Petersburg Times website.

Police reports describe the violence beginning after Doyle’s girlfriend failed to bring him dinner when she returned from work. She told Pinellas sheriff’s deputies her boyfriend was drunk and he tried to force her to have sex. When she refused he became violent throwing a chair at her, hitting her and chasing her around their apartment. FDLE reports show that Doyle has been convicted on DUI charges twice since 2000.

TAMPA CRIMINAL BLOG: Police Chase And Catch Pair Who Allegedly Robbed Ybor City Bar

A burglary at the Honeysuckle Bar in Ybor City Thursday morning led to a police chase and the use of a helicopter to track down the alleged suspects. The police chase lasted 10-15 minutes according to a report on the Tampa Tribune’s website and took police through the Sulphur Springs and College Hill neighborhoods to the north of Ybor City.

The helicopter was used to track the fleeing car which followed the suspects to a house where a man and woman exited the car and then ran into the home. The report does say police then entered the house and arrested two men who surrendered peacefully. Whether the robbery suspects are two men or a man and a woman still remains to be seen as details emerge.

SARASOTA DUI BLOG: Former Braden River High School Football Coach Could Face DUI Manslaughter Charges

According to an article published in today’s Bradenton Herald Tribune, the Florida Highway Patrol have found enough evidence against former Braden River High School head football coach Josh Hunter to support a charge of DUI manslaughter. It is now up to the State Attorney’s Office to decide how they will proceed with the case. On Tuesday investigators said they are examining reports from a blood sample taken following the crash that Hunter was involved in.

The traffic accident took place in March. Hunter’s SUV overturned and killed his best friend and fellow coach Doug Garrity. The investigators have not indicated what Hunter’s blood-alcohol level was and it may take a few weeks to decide on whether to file charges. Hunter stepped down as the coach at the East Manatee school following the tragic crash. Although the FHP received results of Hunter’s toxicology tests in April, a spokesman said it took months to finish the report due to the number of cases the FHP is handling.

TAMPA CRIMINAL BLOG: Polk County Sheriff’s Sting Prostitutes And Pimps Using Craig’s List

For three days the Polk County Sheriff’s Office ran a sting called “Operation Hot Date” and their target was prostitutes and pimps who were using Craig’s List to set up meetings. The operation resulted in 28 prostitutes and four pimps being arrested. Those arrested came from Tampa, Pinellas, Orlando, West Palm Beach and Riverview. Undercover officers contacted the woman via Craig’s List and negotiated prices for sexual acts between $125 and $800 according to a story at www.tbo.com.

Polk County Sheriff Grady Judd put some of the blame squarely on the doorstep of California based Craig’s List for the problem and despite the lack of customers arrested, Judd said that may change shortly. He claimed to have the cell phones and contact books from the prostitutes arrested and their customers may be hearing from Polk County Sheriff’s shortly.

TAMPA CRIMINAL BLOG: Tampa Man And Woman Shot By Ex-Boyfriend Sunday Morning

A Tampa couple was shot early Sunday morning in what is being labeled a domestic dispute as the alleged shooter is the woman’s ex-boyfriend according to a story in today’s St. Petersburg Times. Eric Brewer has died from injuries suffered due to the gunshot while his girlfriend Shirley Sexton is in critical condition at Tampa General Hospital. The suspected shooter is William Privett who surrendered to his attorney who informed the Sheriff’s office.

The couple were sitting in a Chevy Blazer in Hillsborough County Sunday morning when Privett pulled up to them in his 2005 Dodge. He fired shots into the couple’s car and then fled the scene. He has been charged with first-degree murder. The article also reports that Privett has been charged before. In 2007 he was charged with assault with a deadly weapon.

TAMPA CRIMINAL BLOG: Argument Over Speeding Leads To Shooting Death That’s Ruled Self Defense

In February of 2008 Charles Ponday was set on protecting his Thonotosassa community from speeding cars. He stopped a fast moving truck and asked its driver to slow down. The incident quickly turned violent as a drunk passenger in the truck began beating Ponday. As 24-year-old Casey Landes was on top of Ponday ready to continue to beat him he was shot in the head by Ponday’s .40 caliber Glock.

The St. Petersburg Times now reports that Hillsborough Circuit Judge Robert Foster has tossed out the charge of manslaughter against Ponday claiming he fired the shot in self-defense under Florida’s “stand-your-ground” law. His case was buoyed by the driver of the truck who said Ponday never took a swing at his drunk friend and was bicycling away from the truck when he was attacked.

FLORIDA DUI BLOG: Man Drinks One Beer In Two Hours, Blows 0.00 Yet Ends Up Charged With DUI?

A 72-year-old Cape Coral, Florida man is going on the offensive after his recent DUI charge. Vincent Tallo was arrested at a DUI checkpoint last weekend after claiming to have had one beer in a two-hour span and passing a breathalyzer test. He spoke out against his arrest in an article published on the Tampa website 10connects.com.

Tallo was stopped at a DUI checkpoint last week and admitted to having a beer that night. After complying with the officer’s request to perform field sobriety tests, Tallo was placed under arrest for DUI. At that point he requested he be given a breath test, which he claims came back with a reading of 0.00. Following that test officers sent him to a portable urinal to provide a urine sample. Police claim something showed up in Tallo’s urine but they won’t know what until the results come back from the lab.

St. PETERSBURG CRIMINAL BLOG: Three Off Duty Officers Cleared In Taser Incident At Tampa Bay Rays Game

Three St. Petersburg officers who were off duty at a Tampa Bay Rays game at Tropicana Field in May have been cleared of charges they used unnecessary force following a Taser incident with one unruly fan. The officers were cleared of any wrong-doing by the chain of command board.

The incident took place in section 141-145 of the Trop. Security personnel called the off duty officers to help them take Tyler Strangman into custody for fighting according to reports and a story published on the Tampa Tribune website. Strangman’s cousin Daniel Weightman became agitated about the way his cousin was being treated by stadium security. He was eventually escorted from his seat and allegedly threw an elbow at one of the officers. When Weightman was told to stop resisting he did not comply and was shocked.

Weightman was listed as a juvenile in the police report and his mother and other family, who were at the game as well, claimed the officers used excessive force on the teen, used profanity and that the officers were apparently celebrating the Taser incident back at the police station.

TAMPA CRIMINAL BLOG: Criminal Charges May Be Coming For Mother Whose Daughter Died In Crash

Yesterday we talked about the case of Amanda Nelson on this very blog. The story has taken a tragic turn as her seven-year-old daughter has died from injuries suffered in a one-car accident. The girl was one of 11 children in the van and none had on seatbelts. Detectives and the Hillsborough County State Attorney’s Office have not charged the woman yet according to the St. Petersburg Times but her lengthy record of license suspensions and other violations may weigh into how the State Attorney proceeds.

Nelson had 11 children in her van headed to Little League when she ran into a retaining wall. The Carrollwood woman has had her license suspended six times and a few years ago she paid a fine for not having a car seat for a child. In 2007 she was booked into Orient Road Jail in Tampa after being cited for driving on a suspended license.

St. PETERSBURG CRIMINAL BLOG: St. Pete Man Cleared Of Rape Charges After DNA Test

Lindsey Sermon was supposed to be heading to court for a trial on charges of sexual battery and robbery this morning. Thanks to a DNA test that won’t be happening as Pinellas-Pasco State Attorney’s Office has dropped the charges against Sermon according to today’s Tampa Tribune. The Pinellas man was charged after being accused of raping a woman in October.

The case against Sermon was based on the accusations of a woman who had previously been convicted of making false allegations. It probably didn’t help that Sermon was an ex-con who was allegedly selling marijuana to his accuser. The Public Defender for Sermon fought the $700,000 bail and now has been successful in getting all the charges dropped.

TAMPA CRIMINAL BLOG: Man Arrested Driving In A Car That Looks Like An Unmarked Cruiser With A Police Scanner

Nathaniel Fine was pulled over by Collier County sheriff’s because he was driving a car that looked like an unmarked police cruiser according to a report in the Bradenton Herald. Police reports indicate the 20-year-old had a car outfitted with red lights in the back and a police scanner. Under Florida law, it is illegal to have a police scanner in a car unless the operator has a radio license or his job requires having a scanner in a car.

Upon pulling Fine over, sheriff’s deputies found an expandable baton inside the car and they later discovered marijuana as well. Fine was charged with possession of marijuana and possessing a radio scanner tuned to law enforcement frequencies.

MANATEE CRIMINAL BLOG: Teenager Calls His Dad After A Failed Drug Buy And Car Chase Ensues

You almost have to read this to believe it. Four people ended up in the hospital in Manatee County earlier this week following a failed drug buy where a teenager was robbed and he then called his father for help. That call led to a car chase and then a crash according to the Sarasota Herald Tribune.

The Florida Highway Patrol and Manatee Sheriff’s Office believe 18-year-old Donald Porter got into Michael Gesregan’s truck with the intent to buy drugs. Gesregan allegedly pulled a gun on the teen and robbed him. Porter called his father who chased after Gesregan’s car. The two cars collided leaving four people in need of medical treatment. Gesregan and his passenger were both believed to have ingested drugs while the younger Porter is accused of taking property off his father’s person following the crash.

SARASOTA CRIMINAL BLOG: Cop Captured Kicking Suspect On Video Tape Will Not Be Charged

Sarasota officer Christopher Childers will not face any criminal charges even though he was caught on tape kicking a suspect in handcuffs. Juan Perez was bloody and covered in urine outside the Sarasota County Jail after video caught Childers kicking the 21-year-old while he was lying on the ground. The case gained widespread notoriety not only because of the videotape but what happened after the incident. An investigator, acting on behalf of the police department, went to Perez and offered him $400 to waive all rights to sue the city over the beating.

According to Todd Ruger of the Sarasota Herald Tribune the State Attorney’s office said the kicks delivered by Childers were legally justified since Perez escaped from the patrol car and did not respond to lawful commands. It has been reported that Perez had a blood-alcohol level three times the legal limit at the time of his arrest.

St. PETERSBURG CRIMINAL BLOG: Three People Dead Crash In Suspected Street Race

Street Racing was in the news in Pinellas County recently when hundreds of street racing spectators were ticketed rather than those driving the cars. Police felt it was a better way to tackle a problem that is growing on Florida’s streets. A good example of that is a recently deadly crash that police believe was the result of street racing.

The accident took place just north of Daytona Beach in Volusia County. According to reports a red sports car was seen with another car speeding. The red car lost control and collided with a concrete wall. Police say the car was split in half and the male and two females inside were killed instantly. The second car left the scene of the accident.

FLORIDA CRIMINAL BLOG: Tale Of Two Hit-And-Runs Continues In Tampa And Brooksville

Just as the Jordan Vasquez cases seems to be headed to a resolution that involves no jail time for the Tampa teen, the case of another teen who hit and killed someone with his car in Hernando County rages on. Andrew Morris, the 16-year-old was charged with third-degree murder and grand theft auto when he took his parent’s car without permission and crashed into a patrol car killing Captain Scott Bierwiler, was quoted in court documents printed in the St. Pete Times today.

Morris said he left his house that fateful night angry at his mother but he had no illegal drugs or alcohol in his system. He admitted to taking his mother’s car without permission even backing it out of the driveway in neutral so she wouldn’t hear him driving off. He said while he didn’t think about it at the time, he was aware that was a crime. Five hours elapsed between the time the teen left the house and the accident that took the officer’s life and Morris accounted for his time, which he said was spent driving around and even napping in his school’s parking lot.

According to Tampa Bay Online, the Hillsborough County State Attorney’s Office has decided to drop charges against Stormy Daniels. According to the report the state couldn’t determine who was the aggressor in the case, there were no injuries and the porn star’s husband waived prosecution.

The porn star, whose given name is Stephanie Clifford was accused of hitting her husband in the face and throwing things at him. The domestic dispute occurred after Daniels’ husband allegedly didn’t pay some bills leading to an argument that escalated into violence.

TAMPA CRIMINAL BLOG: Woman Stabs Her Boyfriend And Then Turns The Knife On Herself

An argument between a Tampa couple turned ugly Monday night after 45-year-old Jose Peralsoquendo reportedly told his girlfriend to move out. According to a police report, the unidentified woman stabbed Peralsoquendo in the chest and then stabbed herself as well. The woman has had prior arrests for assaulting her boyfriend. (read more)

The assault happened just after 10:00 p.m. on W. Chestnut St. After he was stabbed, Peralsoquendo went to a neighbor’s apartment to call the police. He was then taken to the hospital with injuries that were not life-threatening. Police are on the lookout for the unidentified girlfriend in hopes of bringing her in for questioning.
